In no event shall pageory’s total liability to you for all damages, losses, and causes of action exceed the amount you paid us during the twelve (12) months preceding the event giving rise to the liability, or one hundred U.S. dollars ($100.00) if you have not paid us anything, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
7. Indemnification
You agree to defend, indemnify, and hold pageory and its directors, employees, partners, agents, and affiliates harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney’s fees) resulting from or arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

9. Changes to Terms
We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. 10. Dispute Resolution
10.1 Informal Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Dispute”), the parties shall first attempt to resolve the Dispute informally by sending a written notice of the Dispute to the contact email provided in Section 12. The parties shall attempt to resolve the Dispute within sixty (60) days of such notice.

The arbitrator shall be neutral and qualified. Judgment upon the arbitration award may be entered in any court of competent jurisdiction.
10.3 Class Action Waiver
You and pageory agree that each party may bring disputes against the other party only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
10.4 Equitable Relief
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property rights, confidentiality, or other matters where monetary damages would be inadequate.

Subject to the dispute resolution provisions in Section 10, the courts located in the State of Delaware, United States of America, shall have exclusive jurisdiction over any legal action or proceeding arising out of or relating to these Terms or the Service.
